Tender for the supply of Electric Fork Lift Truck (EFLT) 2.5 ton with 4 wheels (the "Tender") Tender No. ASH-1016-10.2009

Postponement of the last date set for Submission of Proposals
  1. Further to the announcement made on May 27, 2010 (the "Announcement") with respect to the Tender, Ashdod Port Company Ltd. wishes to inform that the last date set for submission of proposals, as indicated in Section 4 to the Announcement, is hereby postponed to Thursday, July 29, 2010 at 14:00 IL time.
  2. All other provisions included in the Announcement remain the same.

  1. Pursuant to the Mandatory Tenders Law, 1992 and the Mandatory Tenders Regulations, 1993 Ashdod Port Company Ltd. (hereinafter referred to as “APC“), hereby invites proposals for the supply of:
    Four (4) Electric Fork Lift Trucks 2.5 ton with 4 wheels (each, an "EFLT ", and collectively, " EFLTs "), warranty and training services.
  2. APC shall have the option, at its sole discretion, for a period of three (3) years from the date of APC's execution of the agreement with the selected Proposer, to purchase up to additional three (3) EFLTs at the same terms of the four (4) EFLTs purchased.  
  3. Pre-requisites
    Authorized distributors of manufacturers of the Proposed EFLTs (the "Proposer(s)") shall be entitled to participate in this Tender, provided that all the following conditions are met upon submission of proposals to the Tender:
    3.1 Proposer is authorized by the manufacturer of the proposed EFLTs to distribute the proposed EFLTs in Israel; and
    3.2 Proposer owns a valid permit from the Ministry of Transportation of Israel to import the proposed EFLTs to Israel; and 
    3.3 Proposer has supplied as of 1.1.2007 until the last date set for submission of the Proposals to the Tender (as specified in Section 4 below) at least thirty (30) EFLTs, manufactured by the manufacturer of the proposed EFLTs, of at least 1.5 up to 3.5 ton lifting capacity to end users/consumers in Israel; and
    3.4 Proposer shall prove compliance by the manufacturer of the proposed EFLTs with all the following conditions:
       3.4.1 Manufacture of at least one thousand  (1,000) EFLTs of at least 1.5 up to
               3.5 ton lifting capacity, per year, during years 2007 - 2009; and
       3.4.2 Certified according to ISO 9001:2000 or ISO 9001:2008 quality standards or
               corresponding quality standards
    approved by APC;and
    Regarding compliance with the aforementioned preconditions in sections 3.4.1 and 3.4.2, APC may recognize, at the APC Tender Committee's sole discretion, such conditions as fulfilled by Affiliated Companies of the manufacturer and/or by companies that have been sold to and/or merged into the manufacturer, insofar as this took place before issue of this Tender, as being fulfilled by the manufacturer itself. “Affiliated Company” means a company wholly owned by the manufacturer, or the manufacturer's parent company, or other affiliated companies of the manufacturer which are to be approved by APC Tender Committee at it sole discretion and subject to any conditions which the APC Tender Committee shall decide to apply.
    3.5 Compliance with all mandatory items specified in the Technical Specification of this Tender; and
    3.6 Proposer has submitted all certifications required according to the Public Corporations' Transactions Law, 1976 ( (חוק עסקאות גופים  ציבוריים, תשל"ו-1976as specified in the Tender documents.
  4. Proposals should be submitted not later than June 24, 2010 at 14:00 IL Time, to the Tender Box, at the chamber of the head of Procurement Department, Equipment Department Building, 1st floor, Port of Ashdod.
  5. APC is not obligated to accept the most inexpensive proposal or any other proposal. APC reserves the right to reject any or all Proposals and to re-advertise or to cancel the invitation for Proposals process.
  6. APC shall be entitled to test and trial the first EFLT delivered to it by the selected Proposer for a period of up to three (3) months.
  7. APC reserves the right to negotiate with selected Proposers.
  8. In this Tender, Proposer whose business is being controlled by a woman shall be preferred, in accordance with and subject to Section 2B to the Mandatory Tenders Law, 1992.
  9. The Tender documents are available as of May 27, 2010 at 08:00 IL Time at the chamber of the head of Procurement Department, Equipment Department Building, 1st floor, Port of Ashdod following payment of 250 NIS, including VAT, not refundable at APC's accounting department.
