Tender for the supply of Compact Track Loaders (CTLs) Tender No. ASH-1017-12.2010 (the "Tender")

Announcement 

Further to the announcement made on December 30, 2010 (the "Announcement") with respect to the Tender, Ashdod Port Company Ltd. ("APC") wishes to inform as following:

The last date set for submission of the proposals, as specified in Section 4 to the Announcement, is hereby postponed to Tuesday, March 3, 2011 at 14:00 IL time.

All other provisions included in the Announcement remain the same.

  1. Pursuant to the Mandatory Tenders Law, 1992 and the Mandatory Tenders Regulations, 1993 Ashdod Port Company Ltd. (hereinafter referred to as “APC“), hereby invites proposals for the supply of:
    Two (2) Compact Track Loaders (each, an "CTL", and collectively, "CTLs"), warranty, training services and spare parts.
  2. APC shall have the option, at its sole discretion, for a period of three (3) years from the date of APC's execution of the agreement with the selected Proposer, to purchase up to additional three (3) CTLs at the same terms of the two (2) CTLs purchased. Notwithstanding the above, the price of the CTLs underlying the option purchased by APC as of the second year of the agreement may be increased by up to two (2) percent, per each year, all subject to negotiations conducted with APC.
  3. Pre-requisites
    Authorized distributors of manufacturers of the Proposed CTLs (the "Proposer(s)") shall be entitled to participate in this Tender, provided that all the following conditions are met upon submission of proposals to the Tender:
    3.1 Proposer is authorized by the manufacturer of the proposed CTLs to distribute the proposed CTLs in Israel; and
    3.2 Proposer owns a valid permit from the Ministry of Transportation of Israel to import the proposed CTLs to Israel; and
    3.3 Proposer has supplied to end users/consumers in Israel, in each year during years 2008 – 2010, at least twenty five (25) Compact Track Loaders and Skid steer Loaders of at least 34 KW (45.5 hp) up to 74 KW (99.2 hp) power, manufactured by the manufacturer of the proposed CTLs; and

    3.4 Proposer shall prove compliance by the manufacturer of the proposed CTLs with the following condition:
    3.4.1 Certified according to ISO 9001:2000 or ISO 9001:2008 quality standards or corresponding quality standards approved by APC; and

    3.5 Compliance with all mandatory items specified in the Technical Specification of this Tender; and
    3.6 Proposer has submitted all certifications required according to the Public Corporations' Transactions Law, 1976 as specified in the Tender documents. ((חוק עסקאות גופים ציבוריים, תשל"ו-1976
    It is hereby clarified that the Proposer and the manufacturer, as applicable, must prove their compliance with the aforementioned preconditions specified in sections 3.1, 3.2, 3.3, 3.4 and 3.6. APC shall not recognize such conditions as fulfilled by affiliated companies or parent companies of the Proposer or the manufacturer, or by any other party which is not the Proposer or the manufacturer itself.
  4. Proposals should be submitted not later than March 3, 2011 at 14:00 IL Time, to the Tender Box, at the chamber of the head of Procurement Department, Equipment Department Building, 1st floor, Port of Ashdod.
  5. APC is not obligated to accept the most inexpensive proposal or any other proposal. APC reserves the right to reject any or all Proposals and to re-advertise or to cancel the invitation for Proposals process.
  6. APC reserves the right to purchase the CTLs from one or more Proposers.
  7. APC shall be entitled to test and trial the first CTL delivered to it by the selected Proposer for a period of up to three (3) months.
  8. APC reserves the right to negotiate with selected Proposers.
  9. In this Tender, Proposer whose business is being controlled by a woman shall be preferred, in accordance with and subject to Section 2B to the Mandatory Tenders Law, 1992.
  10. The Tender documents are available as of January 2nd, 2011 at the chamber of the head of Procurement Department, Equipment Department Building, 1st floor, Port of Ashdod following payment of 250 NIS, including VAT, not refundable at APC's accounting department.
