Further to the announcement made on April 14, 2011 as updated on 01.06.2011 (both shall be referred to as the: "Original Announcement") with respect to the Tender, as follows:
Pursuant to the Government Procurement Agreement (GPA), the Mandatory Tenders Law, 1992 and the Mandatory Tenders Regulations, 1993, Ashdod Port Company Ltd. ("APC") hereby invites proposals ("Proposals") from suppliers of Ship to Shore Cranes (the "Proposer(s)") for: Design, fabrication, supply, delivery, erection, commissioning, testing and warranting of two (2) Ship to Shore Cranes, as set forth in the Technical Specifications of the Tender (the “Cranes”), Basic Training and Technical Support, as well as Optional Technical Support, Optional Features and Optional Spare Parts, all as defined in the Tender documents.
APC shall have the option, at its sole discretion, for a period of five (5) years from the effective date of the Agreement with the selected Proposer, to purchase up to two (2) additional Cranes at the same terms of the first purchase under the Agreement (the "Crane Option").
Notwithstanding the aforementioned, the price of the Crane Option (if exercised by the APC) as of the second (2nd) year of the Agreement, may be increased by up to two (2%) percent, per each year, subject to negotiations conducted in good faith with the APC.
